1) Agreement to Terms
By accessing or using the site, AI tools, and services, you agree to these Terms.
2) Eligibility & Accounts
You must be 13+. If 13–17, use only with parent/guardian consent; your parent/guardian accepts these Terms on your behalf and is responsible for your activities. Keep credentials secure; you’re responsible for account activity.
3) Orders, Production & Cancellations
Products are custom-made . Production typically begins soon after order. You may request cancellation within 1 hour of purchase at support@teediy.com; we’re not obligated to cancel once production starts. We may refuse/cancel orders (e.g., suspected infringement, prohibited content, pricing/availability errors, fraud).
4) Prices, Taxes, Payments
Prices in USD unless noted; taxes/shipping shown at checkout. Payments processed by third-party processors; you authorize charges to your payment method. Promotions/coupons may carry additional terms.
5) User Content: Ownership & Licenses
As between you and TeeDIY, you own User Content (AI-generated or uploaded). You represent you have all necessary rights to print and license that content. You grant TeeDIY a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt, publicly display/perform, and distribute your content to: (a) fulfill orders; (b) display on product pages, galleries, recommendations; and (c) develop, train, and improve AI models. You may opt out of future model-training use via privacy@teediy.com. We may use automated tools and/or human review to screen content for prohibited material.
6) Prohibited Content & Conduct (Acceptable Use)
You will not submit content that is illegal, infringing (copyright, trademark, publicity/privacy), defamatory, hateful, harassing, deceptive, obscene, exploitative, or that depicts/sexualizes minors, promotes violence or self-harm, or evades sanctions/export controls. No reverse engineering, scraping, or interfering with the service. We may remove content, refuse orders, and/or suspend accounts at our discretion.
7) IP Complaints — DMCA
Send copyright notices to dmca@teediy.com or to our postal DMCA agent (address above). Include: your contact info; identification of the copyrighted work; identification of allegedly infringing material and location; a good-faith statement; a statement under penalty of perjury of accuracy and authority; and your signature.
Counter-Notice: If you believe removal was mistaken, send: your contact info; identification of removed material and location before removal; a statement under penalty of perjury that you believe in good faith the material was removed by mistake; consent to jurisdiction of federal court in your district (or N.D. California if outside the U.S.); and your signature. We may restore content per the DMCA. We may terminate repeat infringers .
8) Shipping & Risk of Loss
Shipping via USPS, UniUni, GoFor (and similar). Title/risk transfer upon carrier’s confirmed delivery to the address you provide. See Shipping Policy.
9) Returns/Refunds
Because items are custom, no returns or exchanges except for defects, misprints, damage, or incorrect items under our Refund/Return Policy.
10) Third-Party Services & Analytics
We use third-party tools (payments, analytics, fraud prevention, marketing). Your use of such tools may be governed by their terms and privacy policies.
11) Disclaimers; Colors & Sizing
Services are provided “AS IS/AS AVAILABLE.” Colors may vary due to display/fabric/ink; sizing has reasonable tolerances; pre-treatment marks or slight variations can occur in normal production.
12) Limitation of Liability
To the maximum extent permitted by law, TeeDIY and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits/revenue/data. Our aggregate liability will not exceed the amount you paid for the order giving rise to the claim.
13) Indemnification
You will indemnify and hold harmless TeeDIY from claims and costs (including reasonable attorneys’ fees) arising from your content, your use of the services, or your violation of law/third-party rights/these Terms.
14) Arbitration; Class Action Waiver; Jury Waiver
Arbitration. Any dispute will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Venue: San Francisco County, California.
Class Waiver. Disputes must be brought individually.
Opt-Out. You may opt out within 30 days of first use by emailing legal@teediy.com with subject “Arbitration Opt-Out.”
Either party may seek injunctive relief for IP or unauthorized use. You and TeeDIY waive jury trial to the extent permitted by law. Small-claims actions are permitted.
15) Export, Sanctions & Compliance
You represent you are not located in a sanctioned jurisdiction or on a restricted list and will not use the services contrary to export/sanctions laws.
16) Force Majeure
We aren’t responsible for delays or failures caused by events beyond our reasonable control (e.g., labor issues, internet outages, carrier failures, acts of God).
17) Miscellaneous
Governing law: California (conflicts excluded); FAA governs arbitration. Assignment permitted by TeeDIY. Severability; waiver by conduct not implied; entire agreement; survival of provisions by nature; notices via email or posting. We may update Terms; continued use = acceptance.
